These Terms of Use ("Terms") govern your use of Poker Clock ("the App"), including the Apple TV companion app, developed and operated by SwiftVisions ("we", "us", or "our"). By downloading or using the App you agree to these Terms. If you do not agree, please do not use the App.
These Terms are in addition to Apple's Licensed Application End User License Agreement, which also applies to your use of the App. Where the two conflict on a matter Apple's agreement covers, Apple's agreement takes precedence.
We grant you a personal, non-transferable, non-exclusive licence to use the App on Apple devices that you own or control, in accordance with Apple's App Store terms. You may not copy, modify, reverse engineer, redistribute, rent, or resell the App or any part of it.
All rights not expressly granted to you remain with SwiftVisions.
The App is free to download and includes a usable tournament clock with built-in blind structures that you can edit, reorder and extend at no cost.
Premium features are unlocked by subscription or by a one-time purchase. Premium currently includes multiple saved tournament configurations, the blind structure creator, scheduled starts, voice selection, Apple TV syncing, and use of an iPhone as a remote control. The specific features included in Premium may change as the App develops.
Poker Clock Premium is offered as an auto-renewing subscription, billed either monthly or annually.
Current prices are shown on the App Store listing and in the App itself, and vary by storefront. The price applicable to you is always shown before you confirm a purchase.
Payment is charged to your Apple Account at confirmation of purchase. Subscriptions renew automatically unless auto-renew is turned off at least 24 hours before the end of the current period. Your account is charged for renewal within 24 hours before the current period ends. You can manage your subscription and turn off auto-renewal in your Apple Account settings at any time after purchase.
Cancelling a subscription stops future renewals. It does not end the current paid period, and Premium remains available until that period expires.
Premium is also offered as a one-time purchase, referred to in the App as Lifetime. This is a non-consumable in-app purchase. It does not renew and is not a subscription. The price is shown on the App Store listing and in the App before you confirm.
"Lifetime" means for as long as the App remains available and supported on the App Store. It does not guarantee that the App, or any individual feature, will be available indefinitely.
A free trial may be offered on the annual subscription. Eligibility is determined by Apple and is limited to one introductory offer per Apple Account within the subscription group, so a trial may not be available to you if you have used one before.
Unless cancelled at least 24 hours before the trial ends, the trial converts automatically to a paid subscription at the price shown. Any unused portion of a free trial is forfeited when a subscription is purchased.
All purchases are processed by Apple. SwiftVisions cannot issue refunds directly. Refund requests are handled by Apple under their terms and can be submitted at reportaproblem.apple.com.
The Apple TV companion app is free and works alongside the iPhone and iPad app. It is a companion display and is not a standalone product.
Apple TV syncing and the iPhone remote require Premium on the device running the clock. The remote also requires Premium on the device being used as the remote. These features communicate over your local network only and require the devices to be on the same network. We do not guarantee performance on networks we do not control, including networks with client isolation, guest access restrictions, or restrictive firewalls.
You agree to use the App lawfully and not to use it in any way that interferes with its operation or with other users' devices on your network.
The App is a timekeeping tool for poker games. It does not facilitate gambling, does not handle money, and does not process wagers. You are responsible for ensuring that any game you run using the App complies with the laws that apply to you.
We may update the App to add, change or remove features, and may require a minimum app version in order to continue using features that depend on our services. Where an update is required, the App will tell you and direct you to the App Store.
We may update these Terms from time to time. The date at the top of this page shows when they last changed. Continued use of the App after a change means you accept the revised Terms.
The App is provided "as is" and "as available", without warranties of any kind, whether express or implied, to the fullest extent permitted by law. We do not warrant that the App will be uninterrupted, error free, or that timing will be accurate in all circumstances, including where the operating system suspends the App or the device loses network connectivity.
To the fullest extent permitted by law, SwiftVisions is not liable for any indirect, incidental, or consequential losses arising from your use of the App, including disputes arising from the running of a game. Nothing in these Terms limits liability that cannot be limited by law.
Apple is not a party to these Terms and is not responsible for the App or its content. Apple has no obligation to provide maintenance or support for the App. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
Any claim relating to the App's failure to conform to a warranty should be directed to us, or to Apple for a refund of the purchase price where applicable.
Your licence to use the App is also governed by Apple's standard Licensed Application End User License Agreement, which applies in addition to these Terms as described in section 1. You can read it in full at apple.com/legal/internet-services/itunes/dev/stdeula.

These Terms are governed by the laws of Sweden, without regard to conflict of law provisions, except where mandatory consumer protection laws in your country of residence provide otherwise.
